As per our Constitution (Indian constitution), A Chief Minister can be removed from his position in a multiple way.

Article 164 outlines the process for the appointment of CM by the Governor, (the Governor is the one who administrates the oath of Chief minister)

No confidence motion - In this scenario, if the ruling govt. fails to prove its strength in the State assembly (if the total state assembly seats are 80 and the running govt. falls short of even 1 seat from the majority like they have 39 seats) the governor has the right to dissolve the assembly and invite other stakeholders to claim the majority and form the govt. 

2. Dismissal by Governor (356) - Under certain circumstances, the governor can recommend the dismissal of the Chief Minister of the respective state if there is a constitutional breakdown, this recommendation is sent to the President of India, if the President approves the President's rule is imposed within the state, and the CM is removed.

3, Resignation of the Chief Minister - The Chief minister of any state has the right to leave his/her post voluntarily, (The reason can be anything from the following)

  • Personal Reason (Health/Family)
  • Political Reason
4. Death or incapacitation - If a CM passes away while in office and or is incapacitated to the point where they can not perform their duties, they are replaced.
5. Legal Disqualification -  Disqualified by the Court for any reason, or under anti-defection law.
6. Removal by the Party Leadership

Yes, after his resignation he can bid for re-election or dissolution of the state assembly however the final decision lies in the hand of the Lieutenant Governor, who would then seek approval from the President of India, after the President's assent the Election Commission of India will announce the fresh date of Election and immediately after the announcement of dates the Modal Code of Conduct (MCC) takes place in the region.

Negative 

  • Political Instability - Already prolonged instability within the party and UT become more effective which can lead to public outrage.
  • Governance Paralysis - Key Policies and Governance might be affected, especially if a strong replacement is not found.
  • Opposition exploitation - The Congress and BJP may use the instability to their advantage.  
  • Split within the Party - Change in leadership may not be acceptable to everyone, which may lead to a split within the party,  
  • Lose of Confidence - although Arvind Kejriwal is the prime accused and under trial before the Court still he is the first choice of Delhiites,

  • Stable Government - After the resignation AAP will seek a new candidate who would be clean and fresh to carry on the policies and UT without any interruptions.
